GENERAL PROVISIONS

These conditions are valid only between the company PROFUMIX S.r.l. , with registered office in Via Giacomo Puccini 19/21, 41121 Modena (Mo), REA MO-391112, VAT number 03476810365, and any person who purchases online on the website www.profumixluxurybrands.com hereinafter referred to as “CUSTOMER” .

These conditions may be subject to changes and the date of publication of the same on the site is equivalent to the date of entry into force. These conditions govern purchases made on the website www.profumixluxurybrands.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, amended by Legislative Decree. n. 21/2014 and by Legislative Decree. 70/2003 on electronic commerce.

OBJECT OF THE CONTRACT

With these general conditions of sale, PROFUMIX S.r.l. sells and the CUSTOMER remotely purchases the tangible movable goods indicated and offered for sale on the website www.profumixluxurybrands.com. The contract is concluded exclusively through the internet, by accessing the CUSTOMER at www.profumixluxurybrands.com and making a purchase order according to the procedure provided by the site itself.

The customer undertakes to read, before proceeding to confirm his order, these general conditions of sale, in particular the pre-contractual information provided by PROFUMIX S.r.l.

PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER – art. 49 of Legislative Decree 206/2005

Before concluding the purchase contract, the CUSTOMER examines the characteristics of the goods that are illustrated in the individual product sheets at the time of the CUSTOMER‘s choice.

Before the conclusion of the purchase contract and before the validation of the order with “payment obligation”, the CUSTOMER is informed about:

• – total price of the goods including taxes, with details of shipping costs and any other costs;
• – terms of payment; – the term within which PROFUMIX S.r.l. undertakes to deliver the goods;
• – conditions, terms and procedures for exercising the right of withdrawal;
• – information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;
• – existence of the legal guarantee of conformity for the purchased goods;
• – after-sales assistance conditions and commercial guarantees provided by PROFUMIX S.r.l.

The CUSTOMER may at any time and in any case before the conclusion of the contract, take note of the information relating to PROFUMIX S.r.l., the geographical address, telephone number, e-mail address, information that is reported, also below:

CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

The sales contract is considered concluded with the sending by PROFUMIX S.r.l. to the CUSTOMER of an e-mail confirming the order. The e-mail contains the CUSTOMER data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent.

The CUSTOMER undertakes to verify the correctness of the personal data contained therein and to promptly communicate to PROFUMIX S.r.l. any corrections. PROFUMIX S.r.l. undertakes to describe and present the items sold on the site in the best possible way.

Nevertheless, some errors, inaccuracies or small differences between the site and the actual product may emerge. Furthermore, the photographs of the products presented on www.profumixluxurybrands.com do not constitute a contractual element, as they are only representative. PROFUMIX S.r.l. undertakes to deliver the goods within 30 days from the sending by PROFUMIX S.r.l. the order confirmation e-mail to the CUSTOMER.

PRICES

Prices are expressed in EURO and inclusive of VAT. All prices refer to the single piece unless otherwise specified. Shipping costs are not included in the purchase price except for promotions, but are indicated and calculated at the time the purchase process is concluded before payment is made.

The CUSTOMER accepts the faculty of PROFUMIX S.r.l. to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time the order is created and indicated in the confirmation e-mail sent by PROFUMIX S.r.l. to the client.

In the event of an IT, manual, technical, or any other type of error that could result in a substantial change, not foreseen by PROFUMIX S.r.l. , of the retail price, which makes it exorbitant or clearly derisory, the purchase order will be considered invalid and canceled and the amount paid by the CLIENT will be refunded within 14 days. from the day of cancellation.

PAYMENT AND SHIPPING

Your purchases will be shipped by PROFUMIX S.r.l. within 24/48 working hours (subject to availability) from the moment of receipt of the order and after payment has been made.

The shipment will be by express courier at a cost of € 7 (the expected delivery times are 24/48 working hours for all of Italy) for purchases that do not exceed 3kg, in case of purchases with a heavier weight the cost will be € 15.

Payment can be made in advance or cash on delivery, directly by paying in cash to the courier upon delivery with an additional cost of € 6. Upon confirmation of order shipment, you will be sent the tracking number with which, by connecting to the portal www.gls-italy.com (or for some foreign destinations to www.dhl.com) you can keep track of your order in any time.

PROFUMIX S.r.l. assumes no responsibility for disruptions attributable to force majeure (strikes, bad weather) or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the internet, in the event that it fails to execute the order within the time stipulated in the contract.

PURCHASES FROM ABROAD

Shipping costs for purchases from abroad will be calculated based on the weight and country of destination of the goods.

AVAILABILITY OF PRODUCTS

The availability of the products refers to the actual availability at the time the CUSTOMER places the order. This availability must in any case be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other CUSTOMERS before confirming the order. Even after sending the order confirmation e-mail sent by PROFUMIX S.r.l. , there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically rectified with the elimination of the unavailable product and the CUSTOMER will be immediately informed via e-mail. If the CUSTOMER requests the cancellation of the order, terminating the contract, PROFUMIX S.r.l. will refund the amount paid immediately from the day it became aware of the CUSTOMER‘s decision to terminate the contract.

CANCELLATION OF ORDERS

Orders are binding, they can be canceled only if the goods have not yet been sent by written communication to be sent by e-mail.

For orders already processed, the CUSTOMER must exercise the Right of Withdrawal and the return of the goods must be at his expense.

RIGHT OF WITHDRAWAL

Pursuant to and for the purposes of the Consumer Code, as amended by Legislative Decree 21/2014, the CUSTOMER is given the right to exercise the right of withdrawal, without any penalty and without specifying the reason, within 14 calendar days from the date of delivery of the purchased good.

To exercise this right, the CUSTOMER must send, within the terms indicated, a PEC email to profumixsrl@legalmail.it or a letter by registered letter with return receipt, in which their data are indicated, namely Name, Surname, Address, Order number, telephone, description of the product (s), any IBAN code and holder of the current account where you are asked to make the transfer or other methods (paypal, braintree, postepay) to make the refund.

As soon as this communication is sent, the CLIENT must send, at his own expense and with a courier of his choice, the product he intends to return, including in the shipment a form (see below) with his data which must be the same as those sent in the communication to exercise the right of withdrawal.

The direct costs of returning the products are borne by the CUSTOMER. The cost is estimated to be equal to a maximum of about 30.00 (thirty / 00) euros. The returned product must be sent to PROFUMIX S.r.l. within a maximum of 14 calendar days from the date on which the withdrawal was communicated.

Once the returned product has been received, PROFUMIX S.r.l. will reimburse the price paid for the product / s for which the right of withdrawal has been exercised, within 14 calendar days from the day on which the withdrawal decision was communicated, provided that the object of the withdrawal has been received by the company, or unequivocal proof has been provided that the shipment has been made by courier.

The CUSTOMER will be held responsible, and therefore not refundable, for the decrease in value of the goods resulting from manipulation other than that strictly necessary to establish the nature and characteristics of the goods.

For products for personal use, for hygienic and health reasons it is not possible to return products that have already been used.

The goods must be returned to:

• PROFUMIX s.r.l.
• Via Puccini 19/21 41121 Modena (Mo).

All risks relating to the transport of the returned product are the responsibility of the CUSTOMER.

The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any accessory equipment) and complete with the attached tax documentation.

Without prejudice to the right to verify compliance with the above, PROFUMIX S.r.l. will refund the amount of the products subject to withdrawal within a maximum period of 14 days, including any shipping costs.

As required by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, PROFUMIX S.r.l. may suspend the refund until the goods are received or until the CUSTOMER demonstrates that he has returned the goods to PROFUMIX S.R.L.

PROFUMIX S.R.L. will reimburse using the same payment method chosen by the CUSTOMER during the purchase. In the case of payment made by bank transfer, and if the CUSTOMER intends to exercise his right of withdrawal, he must provide PROFUMIX S.R.L. , by accessing the contact us section, the bank details: IBAN, SWIFT and BIC necessary for the refund by PROFUMIX S.r.l.

LEGAL CONFORMITY GUARANTEE

In case of receipt of products that do not comply with the orders or are defective, the CUSTOMER has the right to restore without having to bear the costs for the return, of the conformity of the product by repairing or replacing the product.

PRIVACY

Pursuant to Italian law, it is declared that by filling out the order form (e-mail or fax), or by sending their personal data, the user authorizes PROFUMIX S.r.l. to the possession of their personal data. The aforementioned data will only be available to PROFUMIX S.r.l. , which can use them to send information and propaganda material strictly related to the site. Pursuant to the law, the customer has the right to access their data as well as the right to request, at any time, the cancellation, transformation into anonymous form, blocking of data processed in violation of the law, updating, rectification and integration.

LEGAL NOTICES

By accessing this site you agree that the laws and regulations of the Italian state will apply to all matters relating to the use of this site. For any dispute that should arise, the competent court is that of Modena (MO). All the trademarks on the site are registered by their respective owners; unauthorized use of the same will be prosecuted according to the law.
